Social protection of citizens in the sphere of employment: some issues of legal regulation

Abstract

Ensuring the right of citizens to protection from unemployment, guaranteed by article 37 of the Constitution of the Russian Federation, and assistance in employment belong to the functions of the Russian state, which conducts a policy of promoting the rights of citizens to full, productive and freely chosen employment. The article deals with issues related to the implementation of the power of the Russian Federation, transferred to the state authorities of the subjects of the Russian Federation, to make social payments to citizens recognized as unemployed in accordance with the established procedure. Financial support for the implementation of the authority transferred by the Federal center to the regions of the country is provided by non-taxable monetary payments of a targeted nature (subventions), subject to the terms of their use for specific purposes to the budgets of the subjects of the Russian Federation on their accounts from the Federal budget. The content of the concept of “subvention” and the procedure for providing it to the subjects of the Russian Federation from the Federal budget is disclosed. It is shown that in order to ensure the effective use of money and increase the responsibility of the Executive bodies of the subjects of the Russian Federation for carrying out appropriate measures in the field of employment, measures are provided for the control of authorized state bodies over the expenditure of funds allocated from the Federal budget. At the same time, improper use of budget funds may lead to bringing the guilty officials to justice, up to criminal responsibility. A suggestion to include a subvention to the subjects of the Russian Federation on the implementation of social benefits to citizens, recognized in the prescribed manner unemployed, in a single subvention to budgets of subjects of the Russian Federation in the coming years, at least 3 years, ie in 2020–2022.
