Labor law and the digital economy: Russian experience in the context of global trends

Abstract

The article discusses a set of problems associated with the multifaceted impact of the digital economy on labor law. At the same time, common approaches to the modern interpretation of the digital economy and digital labor law are identified. The specifics of the impact of the digitalization of the economy on labor law is noted, the features of this process in Russia are highlighted. Provisions are substantiated that digitalization is gradually changing the nature of labor itself, and it also determines the transformation of labor relations. Particular attention is paid to the features of work on platforms, the regulation of which requires new approaches and solutions. It is concluded that it is necessary in the law to transfer all possible communication between employees (their representatives) and employers (their representatives), as well
as maintaining personnel documentation, into the Internet space, but with the effective use of electronic protocols and signatures, digitalization and archiving of labor information subject to reliable protection of such information. It is noted that the process of production robotization will require solving not only technical problems, but also labor and legal and even ethical problems. At the same time, the digital economy, in addition to the obvious positive aspects, carries many hidden and open threats to the stability of labor relations. The digital economy is considered in the key to a challenge to the science of labor law, which requires an adequate response that provides the necessary balance between stability and social protection of workers, on the one hand, and the needs of the modern economy, on the other.
