Controversial issues construction of a fixed-term employment contract as a form of mutual restriction of the rights of an employee and an employer

Abstract

The article is devoted to the specifics of one of the types of labor contracts allocated by labor legislation — fixed-term labor contracts. The said regulatory model is formulated as an exception to the general rule, which is understood as the conclusion of an employment contract for an indefinite period. In this regard, the fixed-term employment contract has the grounds expressly specified in the law that give the employee and the employer the right to conclude such an agreement, and special procedural rules that determine the specifics of its termination. However, for an agreement of this kind related to such restrictions on the use of the design of a fixed-term employment contract, prohibition norms and norms-procedures should in some
cases be formulated more fully or otherwise. In the article, the authors propose restricting the free conclusion of agreements on the termination of an employment contract by agreement of the parties, allowing circumventing the guarantee standards associated with the conclusion of a fixed-term employment contract, allowing the extension of such a contract while preserving precisely the urgent nature of the new agreement, and changing the procedure for terminating the urgent for individual legal situations employment contract, giving it unity in connection with the grounds for such termination. The authors also express the opinion that the test for hiring a job could be regarded as a special case of concluding a fixed-term employment contract, which would strengthen its managerial capabilities, and recognize that it is necessary to discuss the problem of possible consolidation of the employee’s pre-emptive right to conclude a labor contract for a new term in comparison with other applicants for a vacant seat.
