Contest as a basis for official legal relations: features and problems
Abstract
The person wishing on the basis of the act of the state body to be appointed on public service, and also to conclude the labor contract, should enter first into competitive legal relations with this state body. Competitive election, the act of the state body on appointment to the post of the civil service and the conclusion of an employment contract with a representative of the employer — together form a complex legal structure, by virtue of which the service legal relationship arises. The article analyses in detail the competitive placement for filling the posts of the state civil service in the Russian Federation. Despite common features with other competitive procedures, for example, the competitive placement of posts by faculty and academics, the procedure for replacing posts of the public civil service by competition has a number of significant features that have not yet been adequately covered in the legal literature. In this regard, the author focused on the peculiarities and problems of the competition for the replacement of civil service positions and analyzed the main stages of the emergence, development and completion of competitive legal relations with persons participating in the competition. Two stages of the competition are considered, allocated in the current regulation on the competition for filling the vacant position of the state civil service in the Russian Federation. Based on the analysis of the provisions on the possibility of exclusion from the General rules for filling positions without competition, the conclusion is argued that such a legislative decision is unfounded and unconvincing, the implementation of which in many cases depends on the subjective opinion of the head of a state body, which violates the constitutional principle of equal access of citizens to public service.
