Social support for participants in a special military operation and their family members: Some problems of law enforcement

The article is devoted to the analysis of a number of problems related to the application of legislation on social support measures for participants in a special military operation (SMO). The authors conducted a study of the regulatory and legal regulation of support measures in the field of labor relations, in the field of employment and education, as well as in the exercise of the right to insurance coverage for compulsory state insurance. A special place in the work is given to the definition of the legal status of different categories of participants in the SMO. The authors draw attention to the fact that the issues of social protection of SMO participants have become the subject of research primarily by specialists in the field of military law, while representatives of other fields of legal science, primarily labor law and social security law, have not yet conducted serious research in this area. The paper concludes that, despite the legislator’s desire to unify the legal status of all categories of participants in the field of social support, this has not yet fully happened, and in relation to a number of persons, such as war correspondents, volunteers delivering humanitarian supplies to the war zone, a system of measures social support has not been established at all, which is a clear gap in legislation. Such shortcomings in regulatory regulation have been identified as the absence of legally fixed grounds for refusing to renew an employment contract in the presence of medical and professional contraindications, the absence of a ban on termination of an employment contract at the initiative of the employer with the spouse of the participant of the SMO raising a child, the uncertainty of the concept of “actual educator” to acquire the right to insurance payments in the event of the death of a serviceman. The paper formulates a list of proposed regulatory measures.
